How does renting out a property work if I live abroad — management, taxes and rules?
Short answer
Hire a licensed property manager: in Arizona managing someone else’s rental requires a real estate licence. An owner who lives out of state must name a statutory agent in Arizona and register the rental with the county assessor. Rent is US-taxable; a non-resident owner either has tax withheld from gross rent or elects to file a return and pay on net income, which needs an ITIN or SSN.
Property management is a licensed activity under the Department of Real Estate, so check the manager’s licence as you would an agent’s, and sign a management agreement that fixes the monthly fee, leasing fee, maintenance authority limits, reserve account and reporting [1]. The manager handles tenant screening, the lease, deposits and repairs under the state landlord–tenant act, whose rules on deposits, notice and habitability bind you as the owner [2].
Arizona law requires owners of residential rentals to register the property with the county assessor and, if they live outside the state, to designate a statutory agent in Arizona who can accept legal notices; the assessor also records the rental classification that affects your property tax [3] [4].
On tax, rental income from US property is taxable whether or not you live here. A non-resident owner is subject to withholding on the gross rent unless they elect, by giving the manager the right IRS form, to treat the rent as business income and file an annual return on net income after expenses and depreciation, which almost always costs less; that return needs an ITIN or SSN, and Arizona expects its own non-resident return as well [5] [6].
